Agreement to Terms
Welcome to Precision Martinez Concrete. By using our website, requesting a quote, or hiring us for concrete services, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before proceeding.
If you do not agree with any part of these Terms, you should not use our website or services. We reserve the right to update these Terms at any time, and continued use of our services constitutes acceptance of any changes.
Services Provided
Precision Martinez Concrete provides professional concrete services including but not limited to:
- Driveways, patios, and walkways
- Foundation and slab work
- Stamped and decorative concrete
- Concrete repair, leveling, and replacement
- Commercial concrete services
- Other concrete-related services as agreed upon
The specific scope of work, pricing, and timeline for your project will be outlined in a written estimate or contract before work begins.
Estimates and Quotes
We provide free estimates for most residential and commercial concrete projects. Estimates are based on the information you provide and our site inspection. Final pricing may vary if project conditions differ from what was originally assessed.
All quotes are valid for 30 days from the date of issuance unless otherwise stated. Material costs, labor rates, and availability are subject to change. A deposit may be required before work begins on larger projects.
Payment Terms
Payment terms will be specified in your project contract or estimate. Typical payment structure includes:
- A deposit upon contract signing (typically 25-50% of total project cost)
- Progress payments for larger projects as specified in the contract
- Final payment due upon project completion and your approval
We accept cash, check, and major credit cards. Late payments may be subject to interest charges as permitted by law. If payment is not received as agreed, we reserve the right to place a lien on the property where work was performed.
Project Timeline and Delays
We make every effort to complete projects within the estimated timeline. However, concrete work is subject to weather conditions, material availability, and unforeseen site conditions that may cause delays.
We will communicate any anticipated delays as soon as possible. We are not liable for delays caused by circumstances beyond our reasonable control, including but not limited to severe weather, supply chain issues, or changes requested by the client.
Client Responsibilities
To ensure successful project completion, clients are responsible for:
- Providing accurate information about the project site and any underground utilities
- Ensuring access to the work site, including removal of vehicles, equipment, or obstacles
- Obtaining necessary permits or approvals (unless otherwise agreed in writing)
- Reviewing and approving work plans, finishes, and design choices before installation
- Making timely payments according to the agreed schedule
Failure to meet these responsibilities may result in project delays or additional costs.
Warranties and Guarantees
We stand behind the quality of our workmanship. Specific warranty terms will be provided in your project contract. Our warranties typically cover defects in workmanship but do not cover:
- Normal wear and tear or surface staining
- Damage caused by improper maintenance or use
- Cracking or settlement due to soil movement, tree roots, or acts of nature
- Work performed by others on the concrete surface
- Cosmetic issues such as minor color variations or hairline cracks (which are inherent to concrete)
To make a warranty claim, contact us as soon as you notice an issue. We will assess the problem and determine if it is covered under warranty.
Limitation of Liability
Our total liability for any claim arising from our services is limited to the amount you paid for the specific project in question. We are not liable for indirect, incidental, or consequential damages including but not limited to lost profits, property damage beyond the work area, or personal injury not directly caused by our negligence.
We carry general liability insurance and workers' compensation insurance as required by law. Proof of insurance is available upon request.
Cancellations and Changes
If you need to cancel or reschedule a project, please contact us as soon as possible. Cancellations made after materials have been ordered or work has begun may result in charges for materials, labor, and other costs already incurred.
Changes to the scope of work after a contract is signed may result in additional charges and timeline adjustments. All change orders must be agreed upon in writing before work proceeds.
